Oracle Files New Lawsuit Against Oregon, Seeks Enforcement of $25 Million Settlement

Updated with comment from AG Ellen Rosenblum

Oracle America, Inc. today filed a new lawsuit in Marion County Circuit Court, asking the court to enforce a deal the software company claims it reached with Gov. Kate Brown's then chief of staff, Brian Shipley, in October 2015.

As WW reported today, a senior Oracle official, Ken Glueck, held a series of conversations with Shipley, culminating in an Oct. 19 phone call.

Glueck says during that call, the two men agreed to a settlement in which Oracle would provide the state with $25 million worth of software and services. In return, Glueck says, Shipley agreed the state would drop all claims against Oracle related to Cover Oregon, the failed $300 million health insurance exchange Oracle was hired to build.

Shipley, Brown's spokeswoman, Kristen Grainger, and a spokesman for Attorney General Ellen Rosenblum all strongly deny such a deal was reached.

Oracle now wants the court to decide who's right.

"All outstanding litigation was settled between the State and Oracle this past October," Deborah Hellinger said in a statement. "We are filing this lawsuit to require the State to honor its part of the agreement which was negotiated and agreed to in good faith between both parties."
