Grand Jury Finds Fatal Dec. 17 Police Shooting Was Justified (UPDATED)

A Multnomah County grand has completed its work in the fatal Portland Police shooting of Darryel Dwayne Ferguson on Dec. 17 outside an east Portland apartment.

And the grand jury’s decision was that the actions of Officers Jonathan Kizzar and Kelly Jenson were “justified under the criminal law.” Police said after the shooting that Ferguson was wielding a replica gun.

UPDATE at 4:40 pm: A reminder as the 2011 Oregon Legislature readies to begin on Jan. 10 that state Rep. Lew Frederick (D-Portland) is planning to work on legislation that would in part reform law on police use of forcebecause activists say current law prevents grand juries from indicting cops even when the jurors are deeply troubled by the police response.

Today the Multnomah County Grand Jury returned a not true bill in the death of Darryell Dwayne Ferguson on December 17, 2010 in a residence at 12110 East Burnside in Portland. Mr. Ferguson was fatally shot by police. The grand jury determined that the shooting was justified under the criminal law.

A motion to publicly disclose the transcripts of grand jury testimony will come before the Presiding Court on January 4, If the motion is granted, the transcripts should be available by Friday January 7, 2011.
